PINKY CATs

Terms of Service

Effective date: 1 October 2026 | Version: 1.0

These Terms of Service (Terms) govern your use of PINKY, including PINKY CATs and other websites, applications, assessments, reports, content, account features, communications, artificial-intelligence or memory features, APIs and other services that UNISON-CHORD LTD may make available from time to time (together, the Services).

1. Who we are

The Services are provided by UNISON-CHORD LTD, a company incorporated in the United Kingdom, with an address at 9 Caxton House, Broad Street, Cambourne, Cambridge, United Kingdom, CB23 6JN (we, us or UNISON-CHORD). PINKY and PINKY CATs are service and product names used by UNISON-CHORD. You can contact us at info@pinkycats.com.

2. Acceptance and relationship with other notices

By creating a PINKY account, purchasing a Service, or otherwise accepting these Terms where presented, you enter into a contract with us. Our Privacy Notice explains how we handle personal data. Product-specific notices, including the PINKY CATs Sensitive Data Notice and any External Research Participation Notice, supplement these Terms. A privacy notice is information about processing and is not itself contractual consent to all processing. Where we ask for consent, we do so separately.

3. Eligibility and adults only

PINKY CATs is intended only for people aged 18 or over. You must not start an assessment or create an account for PINKY CATs if you are under 18. You must provide truthful age confirmation. We may restrict or terminate access where we reasonably believe the age requirement is not met.

4. PINKY account and service scope

A PINKY account may be used across Services supplied by UNISON-CHORD. The account is not limited to the initial PINKY CATs assessment. Future Services may include additional psychometric assessments, paid reports, cards or interactive experiences, conversation or AI features, memory or personalisation, couple experiences, mobile applications, APIs and other intimacy-intelligence products. A new Service may have additional product-specific terms. We will not use acceptance of these Terms as a substitute for any consent or notice that law requires for a new data-processing purpose.

5. Account security

You are responsible for maintaining control of your email account, authentication factors and devices used to access PINKY. You must not share one-time passwords, recovery links or access credentials. Tell us promptly if you believe your account has been compromised. We may require re-authentication, invalidate sessions or temporarily restrict access to protect you or the Services.

6. Assessments and sensitive subject matter

PINKY CATs asks about intimate and private topics, including sex life and sexual orientation. Before processing answers that constitute special category data under UK data protection law, we present a separate explicit-consent gate. If you do not provide the required consent, the relevant assessment cannot begin. This requirement reflects the nature of the assessment; it is not permission for unrelated marketing, external research or future unrelated uses.

7. Pre-registration assessment state

During the initial PINKY CATs flow, raw answers provided before registration/account binding are processed transiently to progress the assessment, calculate scoring and prepare a result. They are not intended to be durably persisted before account binding. If you abandon the flow or the transient session expires, that transient answer state is removed in accordance with the service design. This does not prevent us from keeping minimal security, consent or technical evidence that does not contain the raw answers where necessary and lawful.

8. Registration and saving results

Where the flow asks you to register in order to save or access a completed result, registration binds the assessment state to the verified PINKY account and permits the applicable data to be saved under the Privacy Notice and the consent choices recorded for the relevant processing. Terms acceptance, Privacy Notice presentation, special-category explicit consent, research consent and marketing choices are recorded as separate events.

9. Save & Resume

If a Save & Resume feature is available, it is a service-delivery feature and is not a privacy or research consent. After authentication/account binding, an incomplete saved attempt may be retained for the configured Save & Resume period, currently designed as up to 30 days for the initial release, unless the feature tells you otherwise. The attempt may then expire or be deleted. A change to this operational period will be reflected in the applicable notice or product information.

10. Nature of results

PINKY results, content, prompts, explanations, recommendations and other outputs are provided for informational, educational and self-reflection purposes. They are designed to describe tendencies or patterns based on the answers and context you provide. They are not medical advice, a medical or psychological diagnosis, a clinical assessment, therapy, counselling, treatment, a treatment recommendation, safeguarding advice, emergency support, or a substitute for advice from an appropriately qualified professional. You should not use PINKY to diagnose, treat or manage a medical or mental-health condition, or as the sole basis for decisions where professional advice would reasonably be appropriate. Results and outputs may change if your answers, context, scoring model, assessment version or relevant Service functionality changes.

11. No guarantee of personal, health or relationship outcomes

Relationships, sexual wellbeing and intimate decisions are personal and context-dependent. We do not guarantee that using PINKY, following or discussing any PINKY result or content, or sharing a result with another person will improve compatibility, communication, a relationship, sexual wellbeing, health, mental health or any other personal outcome. Use of the Services may lead to disagreement, misunderstanding, emotional discomfort, conflict, disclosure of sensitive information, changes in a relationship, or a relationship ending. You are responsible for deciding whether, when and how to use or share PINKY content in your own circumstances and for obtaining professional advice where appropriate. To the extent permitted by applicable law, we are not responsible merely because a user or another person reacts negatively to, disagrees with, relies on, misinterprets or acts upon PINKY content, or because a relationship changes following use or sharing of the Services, except to the extent the loss or harm results from a matter for which our liability cannot lawfully be excluded or limited. Nothing in this clause excludes or limits mandatory consumer rights or liability that applicable law does not permit us to exclude or limit. If you need medical, mental-health, safeguarding or emergency support, contact an appropriately qualified professional or emergency service.

12. Personalisation, Intelligence and future features

Where described in the Privacy Notice and supported by the applicable lawful basis and special-category condition, saved information may be used to personalise Services and to build, evaluate, validate and improve PINKY Intelligence, scoring methods, psychometric methods, algorithms and models. Product development does not give us a right to disregard privacy law, consent scope, purpose limitation or user rights.

13. AI-assisted features

Some Services may use third-party AI or large-language-model technology to generate or assist with outputs. AI output may be incomplete, inaccurate or inappropriate for your circumstances. You should use judgment before relying on it. We aim to minimise the context sent to external providers and to use provider configurations and contractual controls appropriate to the data involved. Additional notices may apply to future conversational or memory features.

14. User content and permissions

If a Service lets you submit text, feedback, messages or other content, you retain rights you have in that content. You give us a non-exclusive, worldwide licence to host, reproduce, process, adapt and display that content only as reasonably necessary to provide, secure, support and improve the Services, exercise our legal rights, and carry out processing described in the Privacy Notice. This licence does not override data-protection law and ends for identifiable content when it is deleted, except to the extent lawful retention or effectively anonymised outputs remain.

15. Derived outputs, algorithms and intellectual property

The Services, assessment design, scoring logic, software, visual design, taxonomies, documentation, aggregate statistics, algorithms, models and other intellectual property created by or for UNISON-CHORD belong to us or our licensors. We may develop and commercially use or license aggregate statistics, effectively anonymised data products, analyses, algorithms, models and other derived intelligence, provided that the relevant output is not personal data or is otherwise lawfully processed. Removing direct identifiers alone does not automatically make information anonymous, and we do not treat pseudonymisation as anonymisation.

16. Your result and sharing

Your detailed result is private to your account unless you choose to share it or another lawful disclosure applies. Where we provide a share card or shareable representation, it is designed to contain a limited summary rather than raw answers, detailed scores, internal scoring logic, account identifiers, authentication tokens or partner information. You are responsible for deciding with whom to share your own result.

17. External research

Participation in external research is optional and is governed by a separate research notice and consent where required. Declining external research does not prevent access to the ordinary Service. It also does not, by itself, disable internal service evaluation, validation, product development or internal research described in the Privacy Notice where those activities have their own lawful basis and, for special-category data, an applicable Article 9 condition.

18. Acceptable use

You must not use the Services to break the law; harm, threaten, harass or exploit another person; obtain or expose another person’s intimate information without authority; impersonate another person; interfere with security or access controls; scrape or systematically extract protected content or data except where law permits; reverse engineer protected scoring or security mechanisms except where mandatory law permits; introduce malware; probe for vulnerabilities without written authorisation; abuse sharing links; or use the Services to make high-impact decisions about another person without an independent lawful basis and appropriate safeguards.

19. Third-party services

The Services may rely on third-party infrastructure, payment, communications, analytics, security, AI or other providers. Those providers may process information on our instructions or, in limited cases, act under their own terms. Links to third-party services do not mean we control or endorse all third-party content. Payment providers may have their own terms and privacy notices.

20. Free and paid Services

Some Services may be free and others paid. Before you buy a paid Service, we will show the price, main features, payment timing, and any material restrictions. Prices include or exclude taxes as stated at checkout. We will not use false scarcity or fake urgency. Paid features may be introduced separately from the initial free PINKY CATs assessment.

21. Consumer cancellation and digital supply

If you are a consumer, mandatory consumer rights apply in addition to these Terms. For distance contracts, you may have statutory cancellation rights. Where the law permits immediate supply of digital content or a service to affect a cooling-off right, we will obtain any express request, consent or acknowledgement required before supply begins. Nothing in these Terms removes rights that cannot lawfully be excluded.

22. Quality and statutory rights

Where consumer law applies, Services and digital content must meet applicable statutory standards, including requirements that cannot be excluded by contract. Any disclaimers in these Terms are subject to those rights. If a paid Service is not supplied as agreed, statutory remedies may be available.

23. Changes to Services

We may update Services to improve functionality, security, legal compliance, assessment quality or product design. We will not use a Service change to silently broaden a consented purpose. If a change materially affects a paid Service or your legal rights, we will provide notice where required and any remedy required by law.

24. Changes to these Terms

We may update these Terms for legal, security, technical or product reasons. The current version and effective date will be made available through the Service. Where a change materially affects an existing contract, we will give reasonable notice and, where required, seek acceptance or provide a right to end the affected Service. Continued use will not be treated as consent to a new special-category purpose that requires explicit consent.

25. Suspension and termination

We may suspend or restrict access where reasonably necessary to protect users or the Services, investigate suspected misuse, comply with law, address security incidents, or enforce these Terms. We will act proportionately and, where appropriate, give notice. You may stop using the Services at any time and may request account deletion through available account controls or by contacting us.

26. Account deletion

Deletion affects identifiable account data as described in the Privacy Notice. Some records may be retained where required for legal obligations, security, fraud prevention, claims, consent evidence or other lawful purposes. Research or derived information may remain only where it is no longer linked to you in a manner that makes it personal data, or where another lawful basis permits retention. Deletion of an account does not rewrite historical evidence that a consent or acceptance event occurred.

27. Availability

We aim to provide reliable Services but do not promise uninterrupted or error-free availability. Maintenance, security work, third-party failures or events outside our reasonable control may cause interruption. Where a paid Service is materially affected, mandatory consumer remedies remain available.

28. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or mandatory consumer rights. Subject to that rule, we are not responsible for losses that were not reasonably foreseeable when the contract was made, or for business losses suffered by a consumer using the Services for personal purposes. Any separate limitation applicable to a paid business or API service will be stated in the applicable product terms.

29. Governing law and courts

These Terms are governed by the law of England and Wales, except that if you are a consumer living elsewhere you retain the protection of mandatory laws that apply to you and any mandatory right to bring proceedings in your local courts. Nothing in this clause deprives a consumer of non-waivable jurisdictional protections.

30. Contact and complaints

Questions about these Terms may be sent to info@pinkycats.com or UNISON-CHORD LTD, 9 Caxton House, Broad Street, Cambourne, Cambridge, United Kingdom, CB23 6JN. Privacy complaints and rights requests are handled as described in the Privacy Notice.

31. General

If a court finds part of these Terms unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver. We may transfer our rights or obligations as part of a corporate reorganisation, financing or sale only subject to applicable law and without reducing mandatory consumer or data-protection rights. You may not transfer your account to another person without our consent.

Effective date: 1 October 2026.
